General Terms & Conditions of Use

Effective date: 15 May 2026  ·  Version 2.0

These General Terms & Conditions of Use (“Terms”) govern the use of the online marketplace operated by Park Market L.L.C-FZ, a limited liability company incorporated under the laws of the Meydan Free Zone, Dubai, UAE, with license no. 2534826.01 and registered office at Meydan Grandstand, 6th floor, Meydan Road, Nad Al Sheba, Dubai, UAE (“Park Market”, “we”, “our”, “us”).

By accessing, registering, or using the Park Market platform, website, or mobile application (the “Platform”), users (“Users”, “Hosts”, “Guests”) agree to be bound by these Terms.

1. Definitions

Host: any person or legal entity offering a Parking Space for rent via the Platform. Hosts are further classified as either Individual Hosts or Professional Hosts.

Individual Host: a natural person renting their privately-owned Parking Space in a non-commercial capacity.

Professional Host: a legal entity or commercial operator (including hotels, residences, building management companies, and parking operators) renting Parking Spaces in a commercial capacity.

Guest: any person or legal entity renting a Parking Space via the Platform.

Parking Space: a designated parking spaces listed by a Host on the Platform and available for booking.

Booking: a confirmed rental agreement between Host and Guest concluded through the Platform.

Commission: the service fee retained by Park Market on Bookings made with Professional Hosts, as set out in Clause 8.

Guest Service Fee: the flat fee charged by Park Market to the Guest on each Booking, as set out in Clause 8.

Payment Processing Fee: the fee charged by the payment service provider on each Guest transaction, as set out in Clause 8.

“Card Received” Confirmation: the action by which the Guest confirms, through the Platform, that they have effectively received access to the Parking Space (keys, access card, code, remote, or any equivalent means of access), triggering the release of funds to the Host as set out in Clause 8.

Platform: the Park Market website, application, and related services.

2. Scope of Services

2.1 Marketplace Role

Park Market operates a digital marketplace (the “Platform”) enabling Hosts to list Parking Spaces and Guests to search, book, and pay for such Parking Spaces. Park Market acts solely as an intermediary and facilitator between Hosts and Guests. Park Market does not own, lease, manage, or control the Parking Spaces, nor does it provide parking services itself.

2.2 No Agency or Employment Relationship

Park Market is not a party to the rental contract formed between Host and Guest. Hosts and Guests enter into a direct contractual relationship with each other. Park Market shall not be deemed an agent, representative, joint venturer, or employer of any Host or Guest.

2.3 Services Provided to Hosts

Park Market provides the following services to Hosts:

  • Listing and promotion of Parking Spaces on the Platform;
  • Access to Guest inquiries and booking management tools;
  • Secure online payment processing, escrow-style holding of Guest funds, and settlement upon Guest confirmation of receipt;
  • Customer service support limited to the operation of the Platform and payment issues.

2.4 Services Provided to Guests

Park Market provides the following services to Guests:

  • Access to listings of available Parking Spaces;
  • Booking and reservation management through the Platform;
  • Secure online payment channels, including the holding of funds until confirmation of receipt of access;
  • Customer support regarding account usage, booking confirmations, and payment processing.

2.5 Exclusions of Park Market's Role

Park Market acts solely as an intermediary, as a consequence:

  • Park Market does not guarantee the availability, safety, legality, or condition of any Parking Space.
  • Park Market does not provide guarding, surveillance, or insurance services for vehicles or personal property.
  • Park Market shall not be responsible for accidents, injuries, theft, or damages occurring in Parking Spaces.
  • Park Market does not verify compliance of Hosts with applicable laws and regulations beyond standard platform checks.

2.6 Service Limitations

  • The Platform is provided on an “as is” and “as available” basis. Park Market does not guarantee uninterrupted access, error-free operation, or continuous availability of services.
  • Park Market may temporarily suspend the Platform for maintenance, upgrades, or technical issues without liability.

2.7 Revenue Model

Park Market derives its revenues from:

  • A Guest Service Fee charged to the Guest on each Booking, as set out in Clause 8;
  • A Commission charged to Professional Hosts on each successful Booking, as set out in Clause 8.

No Commission is charged to Individual Hosts. Rental fees paid by Guests are held by Park Market and released to the Host in accordance with Clause 8.

2.8 Right to Modify Services

Park Market reserves the right, at its sole discretion, to modify, suspend, or discontinue any part of its services, provided that such modifications do not materially prejudice existing confirmed Bookings.

3. Eligibility

3.1 Minimum Age Requirement

  • Guests and Hosts must be at least eighteen (18) years old to register an account and use the Platform.
  • By creating an account, the User represents and warrants that they are at least eighteen (18) years of age and possess full legal capacity to enter into binding agreements.

3.2 Legal Capacity of Individuals

Only individuals who have full legal capacity under the applicable laws of their nationality and residence may register as Users. Persons who are legally incapacitated, under guardianship, or otherwise restricted by law are not permitted to use the Platform.

3.3 Legal Entities

  • Companies, partnerships, and other legal entities may register as Hosts or Guests provided they are duly incorporated, validly existing, and represented by an authorized officer or legal representative.
  • The person registering on behalf of a legal entity warrants that they have full authority to bind such entity to these Terms.

3.4 Compliance with Laws

All Users (Hosts and Guests) must:

  • Comply with the laws of the United Arab Emirates, including but not limited to civil, commercial, and consumer protection laws;
  • Ensure that their activities through the Platform are lawful in their own jurisdiction of residence or incorporation;
  • Obtain and maintain any licenses, permits, or authorizations required for the rental or use of Parking Spaces.

3.5 Prohibited Users

The following persons are expressly prohibited from using the Platform:

  • Persons under the age of eighteen (18);
  • Persons who have been suspended or terminated by Park Market for breach of these Terms;
  • Persons residing in jurisdictions subject to international sanctions or restrictions that legally prohibit the use of the Platform;
  • Persons using false, stolen, or misleading identities.

3.6 Verification

  • Park Market reserves the right to verify the identity, age, and capacity of Users at any time by requesting official identification documents, certificates of incorporation, trade licenses, or other supporting documents.
  • Failure to provide satisfactory verification may result in suspension or termination of the User's account.

3.7 Representations and Warranties

By using the Platform, each User represents and warrants that:

  • They meet all eligibility criteria set forth in this Clause 3;
  • They will use the Platform solely in compliance with these Terms and applicable laws;
  • They are not subject to any legal restriction that would prevent them from entering into a valid contract.

4. User Accounts

4.1 Account Registration

  • To use the Platform, all Users must register and create a personal account (“Account”).
  • Registration requires providing accurate, complete, and current information, including full name, email address, phone number, and any additional information reasonably requested by Park Market.
  • Legal entities registering as Professional Hosts must provide a valid trade license, certificate of incorporation, or equivalent documentation, as well as details of the authorized representative.

4.2 Accuracy of Information

  • Users warrant that all information provided during registration and thereafter is truthful, accurate, and up to date.
  • Users must promptly update their Account information in case of changes (e.g., new contact details, updated licenses).
  • Park Market shall not be liable for losses arising from inaccurate or outdated User information.

4.3 Account Security

  • Users are responsible for maintaining the confidentiality of their login credentials.
  • Users are solely responsible for all activities conducted through their Account, whether authorized or unauthorized.
  • Users must immediately notify Park Market of any unauthorized access, suspected breach of security, or loss of login credentials.

4.4 Restrictions on Account Use

  • Accounts are personal and non-transferable. A User may not assign, sell, or share their Account with any third party without Park Market's prior written consent.
  • Each User may only register one Account unless expressly authorized by Park Market.
  • Accounts may not be used for illegal, fraudulent, misleading, or unauthorized purposes.

4.5 Verification and Validation

  • Park Market reserves the right to verify User identity and credentials at any time, including requesting copies of identification documents, trade licenses, or proof of address.
  • Failure to provide satisfactory evidence of identity or authorization may result in suspension or termination of the Account.

4.6 Suspension and Termination of Accounts

Park Market may suspend, restrict, or permanently terminate a User's Account in cases of:

  • Breach of these Terms;
  • Provision of false or misleading information;
  • Fraudulent, abusive, or unlawful use of the Platform;
  • Repeated failure to comply with payment obligations.

Suspension or termination may be immediate and without prior notice if necessary to protect Park Market, other Users, or third parties.

4.7 Inactive Accounts

  • Park Market reserves the right to deactivate Accounts that remain inactive for more than twelve (12) consecutive months.
  • Users shall be notified at least thirty (30) days before such deactivation.

4.8 Ownership of Account Data

  • All information, data, and content submitted through User Accounts remain the property of the User but are licensed to Park Market for the purpose of operating the Platform.
  • Park Market reserves the right to remove or restrict content that is unlawful, misleading, or in violation of these Terms.

4.9 Representations and Warranties of Users

By creating an Account, Users represent and warrant that:

  • They meet the eligibility criteria in Clause 3;
  • They will maintain only one active Account, unless authorized otherwise;
  • They accept full responsibility for all activities under their Account.

5. Host Obligations

5.1 Legal Right to Rent

  • The Host represents and warrants that they are the lawful owner, lessee, or otherwise duly authorized party entitled to offer the Parking Space for rental.
  • The Host shall obtain and maintain all necessary licenses, permits, or authorizations required under applicable laws in Dubai and the United Arab Emirates for the rental of Parking Spaces.
  • The Host shall provide Park Market with copies of such authorizations upon request.

5.2 Accuracy of Listings

  • The Host shall ensure that all information provided in the listing of a Parking Space (including location, dimensions, accessibility, restrictions, and pricing) is accurate, truthful, complete, and not misleading.
  • The Host must update the listing promptly in case of changes affecting availability, condition, or access to the Parking Space.

5.3 Condition and Safety of Parking Spaces

  • The Host shall ensure that Parking Spaces are maintained in a safe, clean, and usable condition at all times.
  • The Host shall ensure that Parking Spaces are free from structural hazards, illegal use, or obstructions.
  • The Host shall be fully responsible for compliance with fire safety, health, building, and municipal regulations.

5.4 Availability and Access

  • The Host must honor all confirmed Bookings and make the Parking Space available for the full rental period.
  • The Host shall provide clear instructions and access details (keys, access cards, codes, remotes, or other access means) to the Guest in time for the start of the rental period.
  • The Host shall notify Park Market at least thirty (30) days in advance of any unavailability (maintenance, renovations, etc.).

5.5 Exclusivity (Professional Hosts)

Where the Host is a Professional Host bound by a Partnership Agreement with Park Market, the Host agrees that the Parking Spaces listed through Park Market shall not be simultaneously offered through competing platforms or directly to Guests, in accordance with the exclusivity provisions of the relevant Partnership Agreement.

5.6 Insurance

  • The Host shall obtain and maintain adequate liability insurance covering the Parking Spaces where required by applicable law or by their building, residence, or operator.
  • The Host shall provide Park Market with proof of valid insurance coverage upon request.
  • The Host acknowledges that Park Market does not provide insurance for Parking Spaces.

5.7 Compliance with Laws

  • The Host shall comply with all applicable federal and local laws, including but not limited to municipal regulations, building codes, and consumer protection laws.
  • The Host shall be solely responsible for the payment of any taxes, levies, or governmental charges applicable to the rental of Parking Spaces.

5.8 Customer Service and Cooperation

  • The Host shall treat Guests fairly and professionally.
  • The Host shall cooperate in resolving Guest complaints or disputes in good faith.
  • In the event the Host is unable to honor a confirmed Booking, the Host shall bear all costs of relocating the Guest to a comparable alternative parking spaces.

5.9 Indemnification

The Host agrees to indemnify, defend, and hold harmless Park Market, its officers, employees, and affiliates from and against any claims, damages, losses, costs, or liabilities (including legal fees) arising from or relating to:

  • The condition, safety, or legality of the Parking Spaces;
  • Inaccurate or misleading information in the listing;
  • The Host's breach of these Terms or applicable law;
  • Injury, damage, or loss suffered by Guests or third parties in connection with the Parking Space.

5.10 Prohibited Conduct by Hosts

Hosts shall not:

  • List Parking Spaces they do not own or are not authorized to rent;
  • Provide false or misleading information;
  • Cancel confirmed Bookings except in cases of force majeure;
  • Circumvent the Platform by soliciting Guests directly, accepting payment outside the Platform, or otherwise bypassing Park Market's payment system to avoid Guest Service Fees, Commissions, or escrow protection.

6. Guest Obligations

6.1 Proper Use of Parking Spaces

  • Guests may only use the Parking Space for the lawful parking of duly registered, insured, and roadworthy vehicles.
  • Guests shall not use Parking Spaces for storage of goods, hazardous materials, abandoned vehicles, or for any unlawful activity.
  • Guests shall not make structural changes, modifications, or installations in the Parking Space.

6.2 Compliance with Rules

  • Guests must comply with all Host instructions and building rules regarding access, security, and conduct within the premises.
  • Guests must comply with all applicable federal and local laws, including traffic and municipal regulations.

6.3 Payments

  • Guests must pay all rental fees, the Guest Service Fee, and applicable Payment Processing Fees in advance through the Platform, at the time of Booking or at the beginning of each rental month.
  • Guests authorize Park Market to process payments through the designated payment gateway and to set up recurring debits for monthly rentals where applicable.
  • Failure to pay within the deadlines set out in Clause 8 (Payments) constitutes a material breach of these Terms.
  • Any payment made by the Guest outside the Platform is strictly prohibited, falls outside Park Market's escrow protection, and is made entirely at the Guest's own risk.

6.4 Confirmation of Receipt of Access

  • Upon receipt of the access means to the Parking Space (keys, access card, code, remote, or any equivalent), the Guest must confirm receipt via the “Card Received” button on the Platform within a reasonable time.
  • The Guest acknowledges that clicking the “Card Received” button triggers the release of funds from escrow to the Host, and that the transaction is final and non-refundable from that moment onwards, subject only to Clauses 9.5 and 9.6.
  • The Guest must not click “Card Received” before having effectively received and verified the means of access.

6.5 Duration and Vacating

  • Guests must vacate the Parking Space upon expiration or termination of the rental period.
  • Guests shall ensure the Parking Space is returned in the same condition as at the start of the rental, subject to normal wear and tear.
  • If the Guest fails to vacate the Parking Space, the Host (with Park Market's support) may remove the vehicle at the Guest's sole cost and risk after providing written notice.

6.6 Liability for Damages

  • Guests shall be liable for any damage caused to the Parking Space, facilities, or surrounding property by their vehicle or by persons under their responsibility.
  • Guests shall promptly notify the Host and Park Market of any incident, accident, or damage occurring in the Parking Space.

6.7 Insurance

  • Guests must maintain valid motor vehicle insurance, including third-party liability coverage, for any vehicle parked in the Parking Space.
  • Proof of insurance must be provided upon request by the Host or Park Market.

6.8 Prohibited Conduct by Guests

Guests shall not:

  • Use the Parking Space for overnight habitation or camping;
  • Engage in illegal, dangerous, or nuisance activities (e.g., car repairs, engine testing, or fuel storage);
  • Allow unauthorized persons to use the Parking Space;
  • Sublet or assign the Parking Space without Host's prior written consent;
  • Pay the Host directly or otherwise circumvent the Platform's payment system in order to avoid fees or escrow protection.

6.9 Indemnification

The Guest agrees to indemnify, defend, and hold harmless the Host, Park Market, and their respective officers, employees, and affiliates against any claims, damages, losses, costs, or liabilities (including reasonable legal fees) arising out of:

  • The Guest's use of the Parking Space;
  • Non-compliance with these Terms or applicable law;
  • Damage or injury caused by the Guest's vehicle or conduct.

6.10 Accountability

The Guest acknowledges and agrees that:

  • They are solely responsible for their conduct and any consequences arising from their use of the Parking Space;
  • Park Market has no obligation to intervene in disputes between Guests and Hosts, but may, at its discretion, assist in dispute resolution.

7. Duration, Renewal & Termination of Bookings

7.1 Minimum Rental Period

  • The minimum rental period for a Parking Space is one (1) month.
  • Hosts may set longer minimum periods in their listings, but no Booking may be accepted for less than one month.

7.2 Fixed-Term Bookings

  • Guests may choose to book a Parking Space for a fixed term (e.g., three months).
  • Fixed-term Bookings automatically expire at the end of the agreed period, unless expressly renewed by both Host and Guest via the Platform.

7.3 Open-Ended Bookings

  • If no fixed term is specified, the Booking shall be deemed an open-ended monthly rental.
  • Open-ended Bookings shall automatically renew on a month-to-month basis unless terminated in accordance with Clause 7.4.

7.4 Termination by Notice

  • Either the Guest or the Host may terminate an open-ended Booking by providing at least one (1) month's prior written notice through the Platform.
  • Notice periods shall begin on the first day of the following rental month.

7.5 Termination for Non-Payment

  • If a Guest fails to pay the rental fee by the due date, the Host (via Park Market) may issue a formal payment demand.
  • If payment is not received within fifteen (15) days of such notice, the Host may terminate the Booking immediately.
  • In such case, the Host may, at the Guest's expense and risk, arrange for the removal of the Guest's vehicle from the Parking Space.

7.6 Termination for Breach

A Host may terminate a Booking immediately if the Guest:

  • Uses the Parking Space for unlawful or prohibited purposes;
  • Causes material damage to the Parking Space or surrounding property;
  • Repeatedly breaches Host's rules or building regulations.

Park Market may suspend or cancel the Guest's account in cases of repeated or serious breach.

7.7 Termination by Force Majeure

In the event of a Force Majeure Event (as defined in Clause 16), either party may terminate the Booking without liability if the event prevents continued performance for more than thirty (30) consecutive days.

7.8 Consequences of Termination

  • Upon termination, the Guest must immediately vacate the Parking Space and remove their vehicle.
  • Any failure to vacate may result in the Host removing the vehicle at the Guest's sole cost and risk.
  • The Guest remains liable for unpaid rental fees, damages, and any expenses incurred by the Host or Park Market in enforcing this Clause.

7.9 Refunds upon Early Termination

  • If the Guest terminates with proper notice (Clause 7.4), prepaid amounts for unused rental periods which have not yet been released to the Host shall be refunded in accordance with Clause 9.
  • Funds already released to the Host following the Guest's “Card Received” Confirmation are non-refundable.
  • No refunds shall be granted if termination is due to Guest's breach of these Terms.

7.10 Survival of Obligations

Termination of a Booking does not affect obligations relating to:

  • Payment of outstanding fees;
  • Indemnities for damages caused during the rental;
  • Confidentiality and data protection provisions.

8. Payments

8.1 Payment Through the Platform

  • All rental payments, the Guest Service Fee, and the Payment Processing Fee shall be made exclusively through the Platform using Park Market's designated payment service provider.
  • Payments made outside the Platform are strictly prohibited and shall be considered a material breach of these Terms.
  • Park Market shall bear no responsibility whatsoever for any payment made outside the Platform, whether in cash, by bank transfer, or by any other off-Platform means. Such payments are not protected by the Platform's escrow system, are not covered by Park Market's refund, dispute resolution, or chargeback support, and are made entirely at the User's own risk.
  • Park Market shall not be liable for any loss, damage, fraud, or non-performance arising from off-Platform payments, and shall have no obligation to intervene, mediate, recover funds, or otherwise assist in any dispute relating to such payments.

8.2 Advance Payment Requirement

  • Rental fees, the Guest Service Fee, and applicable Payment Processing Fees must be paid by the Guest in advance, at the time of Booking or at the beginning of each rental month, or for the full agreed term in the case of fixed-term Bookings.
  • No Guest shall be entitled to access or use the Parking Space until payment has been received in full by Park Market.

8.3 Recurring Payments

  • For open-ended monthly Bookings, the Guest expressly authorizes Park Market to process automatic recurring monthly payments via debit/credit card or other approved means.
  • Guests must ensure that sufficient funds are available to cover such recurring charges.

8.4 Fee Structure

Park Market's fee structure is as follows:

(a) Guest Service Fee. A flat fee of twenty United Arab Emirates Dirhams (AED 20) is charged to the Guest on each Booking, regardless of whether the Host is an Individual Host or a Professional Host.

(b) Payment Processing Fee. The Guest is also charged the payment processing fees applied by Park Market's payment service provider, at the following rates: 2.9% of the total transaction amount plus AED 1 for payments made with cards issued in the United Arab Emirates; and 3.4% of the total transaction amount plus AED 1 for payments made with cards issued outside the United Arab Emirates (“international cards”).

(c) Host Commission. Park Market charges a Commission of twenty percent (20%) on each successful Booking made with a Professional Host. The Commission is deducted from the rental fee before settlement to the Host.

(d) No Commission for Individual Hosts. No Commission is charged to Individual Hosts. Individual Hosts receive one hundred percent (100%) of the rental fee paid by the Guest, subject only to deduction of any chargebacks, refunds, or amounts owed under these Terms.

(e) Modification of Fees. Park Market reserves the right to modify the Guest Service Fee, the Payment Processing Fee, and the Commission rate by giving Users at least thirty (30) days' prior written notice through the Platform. Such modifications shall not apply to existing confirmed Bookings.

8.5 Escrow-Style Holding of Funds

  • All amounts paid by the Guest through the Platform are collected by Park Market and held on the Guest's behalf in an escrow-style arrangement until the Guest confirms receipt of the means of access by clicking the “Card Received” button on the Platform.
  • Funds shall remain held by Park Market and shall not be released to the Host until the “Card Received” Confirmation is given, except as otherwise provided in this Clause.
  • Prior to the “Card Received” Confirmation, the Guest is entitled to a refund of the full rental amount in the event of the Host's failure to deliver access, in accordance with Clause 9.

8.6 Release of Funds to the Host

  • Upon the Guest clicking the “Card Received” button on the Platform, funds shall be released to the Host within fifteen (15) business days, less the applicable Commission (for Professional Hosts only) and any applicable transaction fees.
  • From the moment of the “Card Received” Confirmation, the transaction is final and the rental fee for the period concerned becomes non-refundable, subject only to Clauses 9.5 and 9.6.
  • If the Guest does not click “Card Received” and does not raise any dispute through the Platform within seven (7) calendar days following the start of the rental period, the Guest shall be deemed to have confirmed receipt, and funds shall be automatically released to the Host on the same terms as a “Card Received” Confirmation.

8.7 Settlement to Hosts

  • Net revenues (rental price minus, where applicable, Commission and any applicable transaction fees) shall be transferred to the Host's designated bank account.
  • All payments shall be made in AED (United Arab Emirates Dirhams), unless otherwise agreed in writing.

8.8 Taxes

  • Hosts are solely responsible for determining, collecting, reporting, and remitting any applicable taxes, including VAT, income tax, or municipal levies, arising from rental income.
  • Park Market shall not be liable for Hosts' non-compliance with tax obligations but may, where required by law, withhold or deduct applicable taxes.

8.9 Late Payments & Default

  • If a Guest fails to pay rental fees by the due date, the Guest shall be deemed in default without further notice.
  • Park Market may apply late payment interest at the rate of 1% per month (or the maximum rate permitted by applicable law, if lower) on any overdue amount.
  • If payment remains outstanding for more than fifteen (15) days, Park Market and/or the Host may suspend or terminate the Booking in accordance with Clause 7.5.

8.10 Refunds and Adjustments

  • Refunds due to valid cancellations or terminations shall be processed in accordance with Clause 9 (Refunds & Cancellations).
  • Refunds shall be issued exclusively through the original payment method used by the Guest.
  • Park Market reserves the right to offset any amounts due to Hosts against chargebacks, disputed payments, or Guest refunds.

8.11 Chargebacks and Disputed Transactions

  • In the event of a chargeback or disputed payment initiated by a Guest, Park Market shall notify the Host and may withhold the corresponding amount from the Host's future settlements.
  • Hosts shall cooperate with Park Market in providing supporting documentation to contest unjustified chargebacks.

8.12 Payment Records and Statements

  • Park Market shall provide monthly financial statements to Hosts detailing all Bookings, payments received, fees deducted, refunds issued, and net amounts transferred.
  • Hosts shall have the right to request clarification within thirty (30) days of receipt of such statements.

9. Refunds & Cancellations

9.1 General Principle

  • The Guest may request a refund of amounts paid through the Platform at any time before clicking the “Card Received” button or before the seven (7) day automatic release period set out in Clause 8.6 has elapsed.
  • Once the “Card Received” Confirmation has been given, or once funds have been automatically released to the Host, the rental fee becomes final and non-refundable, subject only to Clauses 9.5 and 9.6.
  • The Guest Service Fee and Payment Processing Fees are non-refundable except where the refund is caused by a Host cancellation, by Park Market's error, or as otherwise required by applicable law.

9.2 Guest Cancellations Before Receipt of Access

  • If the Guest cancels a Booking before clicking “Card Received” and before the start of the rental period, the full rental amount shall be refunded, less the Guest Service Fee and the Payment Processing Fee.
  • If the Guest cancels less than forty-eight (48) hours before the start date of the rental, Park Market reserves the right to retain a reasonable portion of the rental fee to compensate the Host for the lost reservation, which shall be specified to the Guest at the time of cancellation.

9.3 Guest Cancellations During an Ongoing Rental

  • For open-ended monthly Bookings, Guests may terminate by giving at least one (1) month's prior written notice in accordance with Clause 7.4.
  • Amounts already released to the Host following a “Card Received” Confirmation or automatic release are non-refundable.
  • Prepaid amounts for future rental periods that have not yet been released to the Host shall be refunded in accordance with Clause 9.7.

9.4 Host Cancellations

  • Hosts are expected to honor all confirmed Bookings.
  • If a Host cancels a Booking prior to its commencement without valid justification (e.g., Force Majeure), the Guest shall be entitled to a full refund of all amounts paid, including the Guest Service Fee and Payment Processing Fee.
  • If a Host fails to provide access to the Parking Space at the start of the rental period, the Guest is entitled to a full refund of amounts still held in escrow.
  • If a Host cancels during an ongoing rental, the Host shall provide either an equivalent alternative Parking Space acceptable to the Guest, or a pro-rata refund of unused rental fees that have not yet been released to the Host.
  • Park Market reserves the right to impose penalties, suspend, or terminate the Host's account for repeated or unjustified cancellations.

9.5 Exceptions to Non-Refundability After “Card Received”

Notwithstanding Clause 9.1, the Guest may be entitled to a refund after the “Card Received” Confirmation only in the following limited cases:

  • Where the refund is required by mandatory provisions of UAE consumer protection law;
  • Where the Guest demonstrates that the “Card Received” Confirmation was obtained through fraud, error, or technical malfunction of the Platform;
  • Where the Parking Space becomes objectively unusable through no fault of the Guest and the Host fails to provide an acceptable alternative.

9.6 Force Majeure Refunds

  • If a Booking is cancelled due to a Force Majeure Event (as defined in Clause 16), the Guest shall be entitled to a pro-rata refund of any prepaid unused rental fees, including portions already released to the Host.
  • Neither Park Market nor the Host shall be liable for additional compensation in such cases.

9.7 Refund Processing

  • All refunds shall be processed exclusively through Park Market's payment system to the original payment method used by the Guest.
  • Refunds shall be made within fourteen (14) business days from the date the cancellation or termination request is validated by Park Market.
  • Currency conversion costs or bank charges shall be borne by the Guest, unless the refund results from Host's cancellation or Park Market's error.

9.8 Non-Refundable Situations

Refunds shall not be granted in the following cases:

  • Guest's breach of these Terms (e.g., non-payment, unlawful use of the Parking Space);
  • Damage caused by the Guest to the Parking Space or surrounding property;
  • Early departure by the Guest without proper notice;
  • Termination for Guest's misconduct or unlawful activities;
  • Amounts already released to the Host following the “Card Received” Confirmation, save for the exceptions in Clauses 9.5 and 9.6.

9.9 Chargebacks and Disputes

  • If a Guest initiates a chargeback with their bank or payment provider, Park Market reserves the right to suspend the Guest's account pending resolution.
  • If the chargeback is unsuccessful, the Guest shall reimburse Park Market for all associated fees and costs.

10. Liability

10.1 Role of Park Market

  • Park Market acts solely as an intermediary and platform operator facilitating the conclusion of rental agreements between Hosts and Guests.
  • Park Market does not own, lease, manage, control, or inspect Parking Spaces and therefore disclaims all responsibility for their availability, condition, safety, legality, or suitability.

10.2 Exclusion of Liability of Park Market

To the maximum extent permitted by law, Park Market shall not be liable for:

  • Loss, theft, damage, or destruction of vehicles, accessories, or personal belongings left in Parking Spaces;
  • Accidents, bodily injury, death, or property damage occurring in or around Parking Spaces;
  • Interruptions, errors, delays, or failures of the Platform or payment systems, unless caused by gross negligence or willful misconduct of Park Market;
  • Inaccurate, false, or misleading information provided by Hosts in their listings;
  • Acts, omissions, misconduct, or negligence of Hosts or Guests;
  • Any payment, transfer, or transaction made by a User outside the Platform, including but not limited to cash payments, off-Platform bank transfers, or direct payments between Host and Guest, which fall entirely outside Park Market's escrow protection and dispute resolution mechanisms.

10.3 Host Liability

Hosts are solely and fully responsible for:

  • The legal right to rent their Parking Spaces;
  • Compliance with all safety, building, municipal, and fire regulations;
  • The condition, accessibility, and maintenance of the Parking Space;
  • Any damage, injury, or loss suffered by Guests or third parties in connection with the Parking Space.

Hosts agree to indemnify and hold Park Market harmless against any claims arising from their Parking Spaces or conduct.

10.4 Guest Liability

Guests are solely and fully responsible for:

  • Lawful and proper use of the Parking Space;
  • Any damage caused to the Parking Space, Host's property, or third-party property by their vehicle or conduct;
  • Ensuring that their vehicle is duly insured, registered, and roadworthy.

Guests agree to indemnify and hold Park Market and Hosts harmless against any claims, damages, or losses arising from their use of the Parking Space.

10.5 Limitation of Liability

  • To the maximum extent permitted by law, Park Market's total aggregate liability, whether in contract, tort, or otherwise, shall be strictly limited to the total fees earned by Park Market (Commission and Guest Service Fee) from the specific Booking giving rise to the claim during the three (3) months preceding the event.
  • Park Market shall not be liable for any indirect, consequential, special, exemplary, or punitive damages, including but not limited to loss of profit, loss of opportunity, loss of goodwill, or reputational damage.

10.6 Allocation of Risks

  • Hosts and Guests acknowledge that they are entering into a direct contractual relationship with each other, and that they assume all risks associated with such relationship.
  • Park Market provides only a technological infrastructure and bears no responsibility for disputes between Hosts and Guests, except for payment processing and escrow functions expressly undertaken under these Terms in respect of payments made through the Platform.

10.7 Off-Platform Transactions

  • Any agreement, payment, exchange, or arrangement made between Users outside the Platform falls entirely outside the scope of Park Market's services and these Terms.
  • Park Market does not provide escrow, refund protection, dispute resolution, customer support, or any other service in connection with off-Platform transactions, and shall not be liable for any consequence arising therefrom.

10.8 Third-Party Services

Park Market may integrate third-party payment providers, communication tools, or authentication services. Park Market shall not be liable for errors, failures, or damages resulting from the performance or non-performance of such third-party services.

10.9 Mandatory Law

Nothing in this Clause shall exclude or limit liability where such exclusion or limitation is prohibited under applicable UAE law, including liability for fraud, intentional misconduct, or gross negligence.

11. Insurance

11.1 Host Insurance Obligations

  • Each Host shall, at its own expense, obtain and maintain such insurance as is required under applicable UAE law or by the building, residence, or operator where the Parking Space is located.
  • Professional Hosts shall maintain Commercial General Liability Insurance and Property Insurance covering bodily injury, property damage, and third-party claims arising from or related to the Parking Space.
  • Upon request by Park Market, the Host shall provide valid certificates of insurance evidencing compliance with this Clause.

11.2 Guest Insurance Obligations

  • Each Guest shall maintain, at its own expense, valid and sufficient motor vehicle insurance for any vehicle parked in a Parking Space, including third-party liability, collision, and comprehensive risks, in accordance with the laws of the United Arab Emirates.
  • Guests acknowledge that Hosts and Park Market shall not be liable for loss of or damage to vehicles or their contents unless directly caused by Host's proven gross negligence or willful misconduct.

11.3 Proof of Insurance

  • Hosts and Guests shall, upon request by Park Market or the counterparty, provide satisfactory evidence of valid insurance policies.
  • Failure to provide proof of insurance within seven (7) days of such request shall constitute a material breach of these Terms and may result in suspension or termination of the Account or Booking.

11.4 No Insurance Provided by Park Market

  • Park Market does not provide any insurance coverage to Hosts, Guests, or vehicles.
  • Park Market does not act as an insurer or insurance broker and shall have no obligation to procure or maintain insurance on behalf of any User.

11.5 Disclaimer of Liability for Uninsured Risks

  • Any failure by a Host or Guest to obtain or maintain the insurance required under this Clause shall be at their sole cost and risk.
  • Park Market shall not be liable for any losses, damages, or claims that could have been covered by insurance but were not due to the User's non-compliance.

12. Intellectual Property

12.1 Ownership of Rights

All intellectual property rights in and to the Platform, including but not limited to trademarks, logos, trade names, domain names, software, source code, databases, website design, mobile applications, user interfaces, graphics, text, photos, videos, and other content created or made available by Park Market (“Park Market IP”) shall remain the exclusive property of Park Market L.L.C-FZ or its licensors.

Nothing in these Terms shall be construed as transferring, assigning, or granting ownership of any Park Market IP to any User.

12.2 User-Generated Content

  • Hosts may upload content (e.g., Parking Space descriptions, photos, rules) to the Platform (“User Content”).
  • By uploading User Content, the Host grants Park Market a worldwide, royalty-free, transferable, sub-licensable license to use, reproduce, display, and distribute such content for the purposes of operating, promoting, and improving the Platform.
  • The Host warrants that it owns or has the legal right to use such User Content and that it does not infringe third-party rights.

12.3 Trademarks

  • “Park Market” and all related names, logos, designs, and slogans are registered or unregistered trademarks of Park Market or its affiliates.
  • Users shall not use Park Market's trademarks without prior written authorization, except as necessary for legitimate reference to the services provided through the Platform.

12.4 Breach of Intellectual Property Rights

  • Any unauthorized use of Park Market IP shall constitute a material breach of these Terms and may result in immediate termination of the User's Account.
  • Park Market reserves the right to take legal action, including claims for damages and injunctive relief, against any User who infringes its intellectual property rights.

12.5 Third-Party Intellectual Property

  • The Platform may contain content, trademarks, or intellectual property belonging to third parties. Such rights remain the property of their respective owners.
  • Users may not use third-party intellectual property without the consent of the relevant rights holder.

13. Data Protection & Privacy

13.1 Park Market collects and processes Users' personal data in accordance with applicable data protection laws.

13.2 Park Market, the Hosts, and the Guests undertake to maintain the confidentiality of all non-public information obtained in connection with the use of the Platform, including consumers' personal data, financial information, and exchanged communications. Such information shall be used solely for the purposes of performing these Terms and shall not be disclosed to third parties, except as required by law or with the express authorization of the concerned party. This obligation shall survive the termination or expiration of this Agreement.

13.3 By using the Platform, Users consent to such processing for purposes including account management, bookings, payments, and customer support.

14. Default & Termination of Accounts

14.1 Events of Default

A User (Host or Guest) shall be deemed in default if they:

  • Fail to comply with any material obligation under these Terms (including payment obligations under Clause 8);
  • Provide false, misleading, or fraudulent information during registration or in connection with any Booking;
  • Engage in unlawful, abusive, or fraudulent conduct on or through the Platform;
  • Misuse the Platform, including attempts to circumvent payment systems, accept or make off-Platform payments, or avoid the Guest Service Fee or Commission;
  • Damage the reputation, integrity, or security of the Platform or Park Market;
  • Fail to provide valid insurance or licenses when required under Clauses 5 (Host Obligations) and 11 (Insurance).

14.2 Suspension of Accounts

Park Market may temporarily suspend a User's Account, with or without prior notice, if:

  • There is reasonable suspicion of fraud, illegal activity, or security breach;
  • The User is subject to complaints or disputes requiring investigation;
  • Payment issues are outstanding.

During suspension, the User shall not be able to make new Bookings, and pending payments may be withheld until resolution.

14.3 Termination by Park Market

Park Market may terminate a User's Account immediately and without prior notice in the following cases:

  • Serious or repeated breaches of these Terms;
  • Failure to remedy a breach within fifteen (15) days after written notice;
  • Fraudulent or illegal conduct;
  • Repeated non-payment by a Guest;
  • Repeated cancellations or failure by a Host to honor confirmed Bookings.

Termination shall also apply automatically in case the User becomes insolvent, enters bankruptcy, or is placed under liquidation.

14.4 Termination by the User

  • A User may terminate their Account at any time by providing written notice to Park Market.
  • Termination by the User shall not affect any ongoing Bookings, unpaid fees, or liabilities incurred prior to termination.

14.5 Consequences of Termination

  • Upon termination, the User shall immediately cease using the Platform and all access rights shall be revoked.
  • Any pending payments owed to Park Market shall become immediately due and payable.
  • Ongoing Bookings shall be cancelled unless otherwise agreed between the Host and Guest.
  • Park Market may retain User data as necessary to comply with legal obligations, enforce these Terms, or resolve disputes, in accordance with Clause 13 (Data Protection & Privacy).

14.6 No Liability for Termination

Park Market shall not be liable to any User for suspension or termination of Accounts carried out in compliance with this Clause 14, provided that such action is based on a good faith belief of breach or risk.

14.7 Survival of Obligations

Termination of an Account shall not release the User from obligations relating to:

  • Outstanding payments and financial liabilities;
  • Indemnification obligations under Clauses 5.9 and 6.9;
  • Liability for damages caused prior to termination;
  • Confidentiality and data protection provisions.

15. Abandoned Vehicles

15.1 Notice to Vacate

The Host (or Park Market on its behalf) shall notify the Guest, by email and via the Platform, to remove the vehicle within seventy-two (72) hours, except in cases of urgency or safety.

15.2 Towing by Authorized Operator

If the vehicle is not removed within such period, the Host may appoint an authorized operator to tow the vehicle in accordance with the procedures of the competent authorities in Dubai (Dubai Municipality / Police / RTA). The legally applicable fees (including towing and storage) shall be borne by the Guest.

15.3 Reporting and Impound

Any impoundment, custody, inspection, and access to the vehicle shall be carried out strictly in accordance with official procedures. Park Market and/or the Host may transmit to the competent authorities any identification information necessary (vehicle and/or owner details).

15.4 No Private Sale

Neither the Host nor Park Market shall sell, transfer, or otherwise dispose of the vehicle without the intervention of the competent authorities. Any disposal shall take place exclusively in accordance with applicable law and the decisions of the authorities.

15.5 Recovery of Amounts Due

Subject to applicable law, Park Market may offset against funds processed through the Platform any legally due and undisputed amounts (rent, penalties, towing, storage), without prejudice to other available recovery methods.

15.6 Limitation of Liability

Subject to mandatory provisions of law, the Host and/or Park Market shall not be liable for any loss or damage suffered by an abandoned vehicle resulting from reasonable and lawful measures taken under this Clause.

16. Force Majeure

16.1 Definition

For the purposes of these Terms, a Force Majeure Event means any event or circumstance beyond the reasonable control of the affected party, which prevents or substantially hinders the performance of its obligations under these Terms, including but not limited to:

  • Natural disasters (earthquakes, floods, storms, fires, or other acts of God);
  • Wars, armed conflicts, terrorist acts, civil unrest, riots, embargoes, or blockades;
  • Epidemics, pandemics, public health emergencies, or governmental restrictions related thereto;
  • Strikes, labor disputes, industrial actions, or lockouts;
  • Acts of government, changes in law, expropriation, or compulsory acquisition;
  • Failure or interruption of public utilities, power supply, internet, telecommunications, or transportation networks;
  • Any other event that is unforeseeable, unavoidable, and outside the reasonable control of the affected party.

16.2 Suspension of Obligations

  • If a party is prevented from performing its obligations due to a Force Majeure Event, such obligations shall be suspended for the duration of the Force Majeure Event.
  • The affected party shall not be deemed in breach of these Terms or otherwise liable for any delay or non-performance caused by a Force Majeure Event.

16.3 Notification

  • The party affected by a Force Majeure Event shall notify Park Market and, where applicable, the counterparty (Host or Guest) in writing as soon as reasonably practicable, specifying the nature of the event, its expected duration, and the obligations affected.
  • Failure to provide timely notice shall not prevent a party from invoking Force Majeure, but the party shall be liable for any additional damages caused by the delay in notification.

16.4 Mitigation

The affected party shall use all reasonable efforts to mitigate the effects of the Force Majeure Event and resume performance as soon as reasonably possible.

16.5 Extended Force Majeure

  • If the Force Majeure Event continues for more than thirty (30) consecutive days, either party may terminate the affected Booking upon written notice, without liability.
  • If the Force Majeure Event continues for more than ninety (90) consecutive days, Park Market may terminate affected User Accounts or suspend Platform operations, without liability.

16.6 Refunds in Case of Force Majeure

  • In the event a Booking is terminated due to Force Majeure, Guests shall be entitled to a pro-rata refund of prepaid amounts corresponding to unused rental periods.
  • Neither Hosts nor Park Market shall be liable for additional compensation or damages arising from the termination of a Booking due to Force Majeure.

16.7 Exclusion of Financial Obligations

Force Majeure shall not excuse or delay the Guest's obligation to pay amounts already due and payable prior to the occurrence of the Force Majeure Event.

17. Governing Law & Jurisdiction

These Terms and any non-contractual obligations arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates. The courts of Dubai, UAE, shall have exclusive jurisdiction to settle any dispute, controversy, or claim arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination.

18. Miscellaneous

These Terms constitute the entire agreement between Users and Park Market.

Park Market reserves the right to update these Terms in order to comply with any amendments to the UAE Consumer Protection Law or the UAE Personal Data Protection Law (PDPL), or to reflect changes in its commercial model, fees, or operations. Such updates shall be communicated clearly to Users on the Platform, and continued use of the Platform shall constitute acceptance of the updated Terms.

If any provision is held invalid, the remainder shall remain enforceable.

19. E-Signature & Logs Clause

19.1 Electronic Acceptance

The User acknowledges and agrees that any validations made on the Platform (including, without limitation, checkboxes, “Confirm/Book” buttons, the “Card Received” button, or one-time passwords/OTPs) shall constitute a binding electronic signature, having the same legal effect as a handwritten signature, in accordance with applicable law.

19.2 Evidential Value of Electronic Records

Park Market is entitled to store and archive, in electronic form, all contracts, communications, and validations relating to the use of the Platform. For this purpose, Park Market shall retain technical logs (including timestamps, identifiers, IP addresses, and digital fingerprints) as evidence of acceptance of these Terms and of the transactions performed.

19.3 Binding Force

The User agrees that such electronic records shall constitute admissible and enforceable evidence in legal proceedings and waives any objection to their validity or probative force solely on the grounds of their electronic form.
